LG can't have administrative supervision over all issues of UT of Delhi: Supreme Court
New Delhi/UNI: The Supreme Court's five-judge bench led by Chief Justice of India (CJI) Dr Dhananjaya Yeshwant Chandrachud, in a unanimous verdict on Thursday said that the Lt. Governor cannot have all the administrative supervision over all issues relating to UT of Delhi.
The Apex Court said that the LG's (Lieutenant Governor) powers do not empower him to interfere with the legislative powers of the Delhi assembly and elected government.
The Top Court said that the rights to control services must reside in the democratically elected government.
The Supreme Court in its judgement said that except on subjects of public order, police and land, all services, including Indian Administrative Services (IAS) even if not recruited by the NCT (National Capital Territory) government, would be controlled by the Delhi government as per the Constitutional scheme of governance.
The Apex Court passed the verdict on the issue of the power tussle between the Delhi government and LG over transfer and appointment of officers.
