SC quashes criminal proceedings against Sukhbir Badal, his late father Parkash Singh Badal in forgery, cheating case
New Delhi/UNI: The Supreme Court on Friday quashed the order of Punjab’s Hoshiarpur Court's summoning order, against Shiromani Akali Dal President, Sukhbir Singh Badal, his late father Prakash Singh Badal, and others in an alleged case of forgery and cheating filed against them, in the controversy over the dual constitution of Shiromani Akali Dal.
"Ingredients of offences (cheating and forgery) not made out. Summoning order is nothing but an abuse of law," a bench of the Supreme Court, headed by Justice M R Shah, said.
“No ingredients made out, criminal proceedings quashed, clear case of abuse of law, we are setting aside summoning order," the Apex Court said in its verdict today.
The top court also said, "Before parting we would like to say, We have not expressed anything on SAD Constitution and quashed summons (against late Parkash And Sukhbir Singh Badal) only on the grounds stated as such."
The Supreme Court in its order quashed the Trial court's summons in connection with the complaint over alleged dual constitutions of the party.
Two days after his death, the Supreme Court today delivered its judgment on Parkash Singh Badal's appeal against a cheating and forgery case for submitting different constitutions of Shiromani Akali Dal. Sukhbir Singh Badal is also a petitioner.
